Looking for info for a friend.
She is living in a ‘family home’ with her partner and children but they have decided to end their relationship. She doesn’t have her name on the mortgage so her partner owns the house in his own name. Does she have any rights to a family home like married people do when they split up. She doesn’t want to have to move out with the children as it would be more upsetting on them on top of everything. Looked up the citizens info but its all about married people. She doesn’t work outside the home and hasn’t for many years but was at home looking after the children.

Mummy5God love her, thats a terrible situation to be in!! I cannot remember the ins and outs but I think if she can show she contributed towards the mortgage then she has a stake in the house…but as they are not married I don’t think she is automatically entitled to stay there, although the fact she has had his children must have an impact on that, I hope…tell her to phone the Citizens Information office as they are great!!

Ithink that if she can prove she contributed to the house it will help… because there are children involved, it might make a difference to her.Good luck to her..
Well she hasn’t contributed to the mortgage as he paid it himself……she wasn’t working outside thehome so depended on him for money……was fine when all was well as she was a stay home mum by choice.
Its a horrible situation to be in and one i have been in myself but wont go into detail. all i can say is tell her to get to a solicitor ASAP!!!!!
she was SAHM by choice i presume that was HIM AND HER!!!!!! so therefore she did contribute to the household by raising the children and keeping it clean etc, there are ways and means to go about this and a solicitor will advise her of the proper route. Good luck with it all.
